I was wondering whether there was a view from the Planning Inspectorate on the weight being given to these issues at appeal? Are there any caselaw examples?

It is difficult to get a general view from the Planning Inspectorate on application of policy. However this recent appeal decision reinforces the need for good policies in Core Strategies in order to deliver above Code for Sustainable Homes standards. Look at paragraphs 23 and 24 where the Inspector accepts that seeking above building control standards is acceptable provided that there is a policy in place in your LDF.
